The page lets you know what information of yours we hold, what we do with it, who we will disclose it to and how you can access the information we hold about you. Introduction

Renault and RFS respect and uphold your rights under the National Privacy Principles contained in the Privacy Act 1988 (Cth) ("Privacy Act"). The National Privacy Principles apply to us from their introduction in late 2001.

How do Renault and RFS collect your personal information?

Renault and RFS will generally collect your personal information directly from you and through its Renault Dealers to whom you have provided your personal information. Renault and RFS may also collect personal information from our website, from other directly related companies and from our service providers (such as Roadside Assist).

What do Renault and RFS do with your personal information (apart from your consumer credit information)?

We use your personal information for the purposes of:

We may also use your personal information for customer service requirements, direct mail, marketing communications (via telephone, mobile, fax or email), market research, and product development purposes.

RFS will only use your consumer credit information:

  • a. to assess your application for consumer credit;
  • b. for purposes directly related to the internal management of your loan or the provision of credit;
  • c. in accordance with the consents and authorities you give us in your consumer credit application.

Your commercial credit information will be used in the same way as your other personal information except that it will not be used to access an application by you for consumer credit without your prior consent.

Who will Renault disclose your personal information to?

Renault and RFS may disclose your personal information (other than your consumer credit information):

RFS will only disclose your consumer credit report information to outside persons as permitted by the Privacy Act. Your consumer credit report information will not be disclosed to our Dealers. Dealers will only be advised of whether or not your application for credit has been successful.

Your credit information will not be disclosed to a credit reporting agency for the purposes of assessing an application by you for consumer credit without your prior consent.

Renault and RFS will take reasonable steps to protect the personal information we hold from misuse and loss and from unauthorised access, modification or disclosure.

Openness

You may request access to personal information (including your credit information) we hold about you by contacting the Customer Service Delivery Manager at the address below. Where we hold information that you are entitled to access, we will endeavour to provide you with a suitable range of choices (including direction to a credit reporting agency) as to how access is provided (eg, emailing or mailing it to you). A fee may be charged to cover the cost of retrieval.

If at any time you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may request amendment of it and we will either amend the information or make a record of your comment, as we think appropriate.

Renault Website

In general you can visit the Renault website without telling us who you are. The amount of information that you provide to Renault will depend on the range and number of services that you choose to use. Particular sections of the Renault website may require you to provide Renault with personal information, including your name and email address. Personal information will only be requested if it is necessary to provide a service to you or if it is necessary by law to collect the information.

Renault Australia uses Google advertising programs that place cookies on your computer to collect information about your browsing history (including on external websites). This information, which does not identify you personally, is collected in order to improve your online experience by customising the advertising you see to your interests (including the display of more relevant ads on external websites). You can opt out of these programs at any time by clicking here.

By using the Renault website you agree that the internet is inherently insecure and that accordingly we can only use our best endeavours to secure your personal information and cannot provide any definitive assurance regarding security of personal information. Other than liability that cannot lawfully be excluded, Renault and RFS will not be liable in any way in relation to any breach of security or any unintended loss or disclosure of that information.

Miscellaneous

In this policy "personal information" has the same meaning as under the Privacy Act.

This policy is effective from 29 April 2011. We may change this policy from time to time. Although we intend to observe this Privacy Policy at all times, it is not legally binding on Renault and RFS in any way. From time to time we may regard it as necessary or desirable to act outside the policy. Renault and RFS may do so, subject only to any other applicable contractual rights you have and any statutory rights you have under the Privacy Act or other applicable legislation.

TERMS AND CONDITIONS

    Eligibility Requirements and the Promotional Period
  1. Entry is only open to Australian residents who:
    1. are aged 18 years or over; and
    2. are able to take the prize during the period 15/03/2013 — 17/03/2013
  2. Individuals who enter via the promotional iTunes application must have: (i) a valid iTunes account; and (ii) an iPhone, iPad or iPod Touch with internet connection and iOS 4.3 or later.
  3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Promotion commences on 28/02/2013 and final entries close at 11.59pm AEDST on 10/03/2013 ("Promotional Period").
  5. Entry Instructions, Conditions and Limitations
  6. To be eligible to enter, an entrant must, during the Promotional Period either:
    1. visit www.renault.com.au/renaultsport ("Website") via a desktop computer and follow the prompts in order to download the promotional game online; or
    2. download the 'R.S. Challenge' ("Application") to their iPhone, iPod Touch or iPad in order to access the promotional game.
  7. To enter, entrants must then, during the Promotional Period, play the promotional game in accordance with the game instructions and, upon completion of playing the promotional game, follow the prompts in order to complete the official entry form, by inputting the requested details and submitting the official entry form. For the removal of doubt, entrants may play the promotional game multiple times, however, to qualify their time and enter the promotion, they must complete the official entry form as outlined above.
  8. The Promoter takes no responsibility should an entrant not have the software, hardware or phone plan that would permit access to and use of the Application. To download the Application, the entrant, must during the Promotional Period, visit the iTunes App Store, search for the Application, and download the Application to their iPhone, iPod Touch or iPad in accordance with the directions. The Application is free to download. Standard carrier fees will apply to the download and use of the Application but there is no additional charge for the Application itself. Any cost associated with accessing the internet or downloading data on a iPhone/iPad/iPod Touch is the entrant's responsibility and is dependent on the internet service provider used.
  9. Each time the entrant plays the promotional game and completes the official entry form, their lap time will be ranked on the competition leaderboard featured on the Website and the entrant will receive one (1) entry into the promotion. By entering this promotion, entrants consent to the Promoter displaying their lap time on the Website.
  10. Multiple entries are permitted, however each entry must be submitted separately and in accordance with entry requirements. For the sake of clarity, if an entrant does not complete the official entry form upon completion of a promotional game(s), they will not be entered into the promotion.
  11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  12. The Promoter reserves the right, at any time:
    1. to invalidate any entrant's promotional game(s) which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to App Store accounts; and/or
    2. to disqualify any entrant that the Promoter reasonably suspects has paid, bartered or offered payment or other consideration to another person in exchange for that person participating in the promotion or has otherwise encouraged or procured any person to submit an entry contrary to these Terms and Conditions.
  13. Incomplete or indecipherable entries will be deemed invalid.
  14. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  15. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  16. Winner Determination and the Prize
  17. The top two (2) valid entrants who, at the conclusion of the Promotional Period, have recorded the fastest lap time in a promotional game, as displayed on the competition leaderboard, will be deemed the winners and will each win the prize. In the event of a tie between two (2) or more entrants, the tied entrants will be required to provide to the Promoter an answer to the promotional question "Why should you win the prize?" in twenty five (25) words or less. The Promoter will select the best answer(s) based on relevancy, originality, creativity and literary merit, in order to determine the winner(s).
  18. The prize includes a trip for two (2) adults to Melbourne, Victoria, to attend the 2013 Formula 1™ Australian Grand Prix valued at up to $5,950, depending on point of departure. Prize includes:
    • two (2) x return economy airfares from the winner's nearest capital city to Melbourne, Victoria (only awarded to winners not from Victoria);
    • two (2) nights twin share accommodation at the Crown Metropol, Melbourne on 15/03/2013 and 16/03/2013 (checking out on 17/06/2013), in a standard room;
    • breakfast daily for two (2) adults (included in accommodation package);
    • two (2) Webber Grand Stand passes valid for 16/03/2013 — 17/03/2013 at the 2013 Formula 1™ Australian Grand Prix;
    • one (1) x Paddock Club Tour on site for two (2) adults, valid for 16/03/2013;
    • one (1) x Helicopter Flight over the Grand Prix track for two (2) adults valid for 16/03/2013; and
    • two (2) x official Grand Prix programs to use at the 2013 Formula 1™ Australian Grand Prix.
  19. Spending money, meals (other than those specified above), insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken during the period 15/03/2013 — 17/03/2013 to coincide with the 2013 Formula 1™ Australian Grand Prix, and is subject to booking and flight availability.
  20. Each winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of each prize. Prizes are subject to the standard terms and conditions of individual prize and service providers. The winners may be required to present their credit card at time of accommodation check in.
  21. If a winner resides in Victoria, the airfare component of the prize will be forfeited and not redeemable for cash.
  22. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.
  23. If for any reason a winner does not take the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  24. The 2013 Formula 1™ Australian Grand Prix Webber Grand Stand and Paddock Club Tour passes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject a winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
  25. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or part of the prize) with a prize to the equal value and/or specification.
  26. Prizes, or any unused portion of a prize, are not transferable, exchangeable and cannot be taken as cash.
  27. As a condition of accepting a prize, the winners must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

  30. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  31. The winners will be notified by telephone and email.
  32. This is a game of skill and chance plays no part in determining the winners.
  33. The Promoter's decision is final and no correspondence will be entered into.
  34. Total prize pool value is up to $11,900.
  35. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  36. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  37. Any cost associated with accessing the Website is the entrant's responsibility and is dependent on the Internet service provider used.
  38. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  39. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the 2013 Formula 1™ Australian Grand Prix is cancelled or delayed for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking of a prize.
  40. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
