Introduction
Renault and RFS respect and uphold your rights under the Australian National Privacy Principles contained in the Privacy Act 1988 (Cth) ("Privacy Act"). The National Privacy Principles apply to us.
This policy describes how we manage any personal information we have about you. In this policy "personal information" has the same meaning as under the Privacy Act.
We may change this policy from time to time. Although we intend to observe this policy at all times, it is not legally binding on Renault or RFS in any way. From time to time, we may regard it as necessary or desirable to act outside the policy. Renault and RFS may do so, subject only to any other applicable contractual rights you have and any statutory rights you have under the Privacy Act or other applicable legislation.
What personal information about you does Renault and RFS hold?
Renault and RFS may hold the following information about you:
- name(s), address, email address, telephone number(s)
- date of birth
- vehicle purchase date
- vehicle details
- name of selling dealer
- any additional information you provide, such as when you contact our Customer Relations Department, log in to our website, or call us for roadside assistance
- any information you may provide to us through customer surveys
- any other personal information which Renault or RFS is required to collect for identification and verification purposes
- any additional information provided in a consumer or commercial credit application you make
- any additional information you may provide to us.
How do Renault and RFS collect your personal information?
Renault and RFS will generally collect your personal information directly from you and through its Renault dealers to whom you have provided your personal information. Renault and RFS may also collect personal information from our website, from other directly related companies and from our service providers (such as 24Hr Roadside Assistance).
What do Renault and RFS do with your personal information (apart from your consumer credit information)?
We use your personal information for the purposes of:
- fulfilling our ongoing obligations (including warranty, recall and roadside assistance) to you as the owner/driver of a vehicle we have imported and distributed
- forwarding you further information regarding the Renault vehicle range and our dealers, organising a test drive, and/or responding to any enquiries or comments that you submit to us
- deciding whether to offer you additional credit or to renew credit
- any other purposes you have consented to
- any use which is required or authorised by law
We may also use it for customer service requirements, direct mail, market research, marketing communications (via mail, telephone, mobile, fax or email), market research and product development purposes.
RFS will only use your consumer credit information:
- to assess your application for consumer credit
- for purposes directly related to the internal management of your loan or the provision of credit
- in accordance with the consents and authorities you give us in your consumer credit application.
Your commercial credit information will be used in the same way as your other personal information except that it will not be used to access an application by you for consumer credit without your prior consent.
Who will Renault and RFS disclose your personal information to?
Renault and RFS may disclose your personal information (other than your consumer credit information):
- to each other or related companies (Nissan Motors or NFS)
- to the advisors, consultants and contractors we ordinarily engage for the above purposes (such as mailing houses, insurers, printers, lawyers, accountants and other service providers)
- to one or more of our dealers on condition that they use it for the same purposes as set out above and only in connection with the Renault dealership franchise
- any other person or entity to whom you have consented to Renault and/or RFS disclosing your personal information
- any disclosure which is required or authorised by law, including to AUSTRAC in respect of any suspicious or threshold transactions or activities
- if you have applied for credit from RFS:
- to a credit reporting agency for the purpose of obtaining a credit report about you and/or to allow the credit reporting agency to maintain a credit information file containing information about you
- to a debt collection agency
- with your consent to other credit providers for the purpose of assessing your application for credit
- with your consent to guarantors if a credit arrangement is guaranteed.
RFS will only disclose your consumer credit report information to outside persons as permitted by the Privacy Act. Your consumer credit report information will not be disclosed to our dealers. Dealers will only be advised of whether or not your application for credit has been successful.
Your credit information will not be disclosed to a credit reporting agency for the purposes of assessing an application by you for consumer credit without your prior consent.
Renault and RFS will take responsible steps to protect the personal information we hold from misuse and loss and from unauthorised access, modification or disclosure.
We may also need to provide your personal information to others where we are allowed or required by law to do so. For example to a court, a regulator (such as the Australian Taxation Office), or the police who can in each case compel us to disclose your personal information to them.
We may also provide your personal information to others where it can reasonably be implied from the circumstances that you consent to your personal information being disclosed to them. For example, your consent will be implied for us to use and disclose your personal information to inform you of goods and services which we believe may be of interest to you. Your implied consent can be withdrawn at any time by you contacting us and informing us accordingly.
If we have to send any of your personal information overseas we shall only do so in accordance with the Privacy Act.
Openness
You may request access to personal information (including your credit information) we hold about you by contacting the Manager Customer Service via the contact details below. Where we hold information that you are entitled to access, we will endeavour to provide you with a suitable range of choices (including direction to a credit reporting agency) as to how access is provided. A fee may be charged to cover the cost of retrieval.
If at any time you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may request amendment of it, and we will either amend the information or make a record of your comment, as we think appropriate.

TERMS AND CONDITIONS
- Information on how to enter and the prize forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- Entry is only open to Australian residents aged 18 year or over who hold a current valid Australian driver's licence.
- Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
- Promotion commences on 11/11/2011 and closes at 5:00pm AEST on 1/4/2012 (Promotional Period).
- To enter, entrants must, during the Promotional Period:
- a. attend a Renault Activation Series Event (Event) during opening hours at any of the following locations during the following periods:
- 11 – 13 November 2011: Newcastle Nobby's Beach, NSW;
- 16 – 18 December 2011: Glenelg Beach, SA;
- 20 – 22 January 2012: Surfers Paradise Beach, QLD;
- 03 – 05 February 2012: St Kilda Beach, VIC;
- 17 – 19 February 2012: St Kilda Beach, VIC;
- 09 – 11 March 2012: Surfers Paradise Beach, QLD;
- 16 – 18 March 2012: Scarborough Beach, WA; and

- b. using a Renault iPad at the Event, input the requested details to complete the entry form, including the entrant's guess on the number of beach volleyballs (Volleyballs) in the Mégane Coupe Cabriolet on display at the Event; and
- c. submit the fully completed entry form.
- Only one (1) entry permitted per person.
- Incomplete, indecipherable or illegible entries will be deemed invalid.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Judging will take place on 10/4/2012. The eligible entrant who correctly guesses the correct number of Volleyballs will win the prize. In the event no entrants correctly guess the correct number of Volleyballs, the eligible entrant who has the closest guess to the correct number of Volleyballs (which is not more than the correct number of Volleyballs) will be the winner. In the event an invalid entry or ineligible entrant has the winning guess to the correct number of Volleyballs, the eligible entrant with the next closest guess to the correct number of Volleyballs (which is not more than the correct number of Volleyballs) will be the winner. The Promoter will continue with this process until a winner is chosen.
- In the event of a tie, a draw will take place at 2:00pm AEST on 12/4/2012 at Anisimoff Legal, Suite 3, Erina Plaza, 210 The Central Coast Highway, Erina NSW 2250. The first valid entry drawn from all tied entrants will win the prize. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible tied entrant is drawn.
- The winner will be notified in writing within two (2) business days of the judging (or draw if required) and published in The Australian on 24/4/2012. The Promoter's decision is final and no correspondence will be entered into.
- The prize for the winner will be a Mégane Coupe Cabriolet with automatic transmission. Total prize value is up to AU$50,341 including all on road costs, registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The Promoter may, in its absolute discretion, accommodate the winner's colour preference (excluding metallic options), subject to availability. The winner must collect the prize from their nearest authorised Renault dealership.
- If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded.
- The winner must sign any release form(s) as may be required by the Promoter (and its associated agencies and companies), and/or any other third party directly or indirectly involved in and with the prize and refusal to sign such form(s) shall result in the immediate forfeiture of the prize and that person shall have no claim, action or recourse at law or otherwise, against the Promoter in respect of the forfeiture.
- The prize is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
- A draw for the prize, if unclaimed, may take place at 2:00pm AEST on 12/7/2012 at Anisimoff Legal, Suite 3, Erina Plaza, 210 The Central Coast Highway, Erina NSW 2250, subject to any directions from a regulatory authority. The winner will be notified in writing within two (2) business days of the draw and their name will be published in The Australian on 26/7/2012.
- If for any reason the winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited and will not be redeemable for cash.
- If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any Event is cancelled or delayed for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by the winner or any entrant; or (g) use of the prize.
