Terms and Conditions

 

  1. The Promoter is Vehicle Distributors Australia Pty Ltd (ABN 11 073 668 596) of Ground floor, 4 Nexus Court, Mulgrave, VIC 3170 telephone 03 8561 4800.
  2. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
  3. Entry is open to all residents of Australia who are 18 years of age or over. However, employees and their immediate families of Renault Australia, Salmat Digital Pty Limited, Falls Creek Ski Lifts Pty Ltd, Falls Creek Alpine Resort Management Board, Mount Hotham Skiing Company Pty Ltd and their associated agencies and companies are not eligible to enter.
  4. The competition commences on Saturday 13 February 2016 at 00:01 (AEDT) and concludes on Tuesday 12 March 2016 at 23:59 (AEST).
  5. The competition will be advertised via eDM sent exclusively to the Falls Creek database encouraging their patrons to participate in a Renault test drive campaign. By completing the test drive, participants automatically go into the draw.
  6. To redeem the offer, individuals must complete the following steps during the Promotional Period:

a) Complete a test drive application via http://www.renault.com.au/book-a-test-drive/ and provide your full name, email address, postcode and phone number; and

b) Complete a test drive application at your nominated authorized Renault Dealership which must include your full name, date of birth, phone number and email, and

c) Complete the test drive.

  1. The Promoter reserves the right, at any time, to verify the validity of applicants (including an applicant’s identity, age and place of residence) and to reject any applicant who submits a test drive application or Driver’s Licence that is not in accordance with these Terms and Conditions or who tampers with the redemption process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  2. If there is a dispute as to the identity of an applicant, the Promoter reserves the right, in its sole discretion, to determine the identity of the applicant.
  3. The offer strictly includes:
  • One (1) x $50 fuel card which is non-transferable or redeemable for cash
  • One (1) x Automatic entry into the draw to win a 2016 Falls Creek Resort Entry Pass and a 2016 Falls Creek Resort Hero Pass
  1. The offer strictly excludes:
  • The Falls Creek Resort Falls Creek Resort Entry Pass and Falls Creek Resort Hero Pass being used outside of the 2016 ski season
  • Transfer of these prizes to a sister ski resort
  • Multiple entries by a single person
  • Redemption by anyone who is not a recipient of the Falls Creek resort e-newsletter
  1. Illegible, incomprehensible and incomplete entries will be deemed invalid.
  2. Entrants in the competition may only enter once per person per subscription. Only one prize per person is permitted.
  3. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill or store receipt for purchase requirement) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
  4. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
  5. Entries must be received by 23:59 (AEST) on Tuesday 12 March 2016.  The time of online entry is received by the Promoter’s database The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
  6. Any entry that is made on behalf of an Entrant by a third party will be invalid.
  7. The cost of accessing the promotional website will be dependant on the entrant’s individual Internet Service Provider.
  8. There will be one (1) winner drawn at random who successfully completed a test drive. The prize includes:
  • One (1) 2016 Falls Creek Resort Entry, valued up to AU$325.00*
  • One (1) 2016 Falls Creek Hero Pass, valued up to AU$749.00*

  1. Total prize value is up to = AU$1,074.00 (including GST)
  2. Prizes cannot be transferred and cannot be redeemed for cash.
  3. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
  4. FOR ACTION ADVENTURE/ADRENALIN PRIZES: By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in this Falls Creek Hero Pass should they be chosen as the winner. The winner releases the promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the Falls Creek Hero Pass or any other aspect of the prize. The winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize.
  5. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
  6. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.  It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
  7. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
  8. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
  9. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
  10. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Renault Australia or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
  11. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  12. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  13. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
  14. Each valid entrant who has entered the competition over the duration of the promotional period will be entered into the draw.  One (1) valid entrant will be drawn at random to become the winners. The draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060, on Friday 15 April 2016 at 10:00 (AEST).
  15. If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.
  16. The winner will be notified within 2 days of the draw (required for NSW Permits). The winners will be notified of their prize in writing. Winners of prizes valued over $250 will have their details published in the Public Notices section of The Australian newspaper on Friday 22 April 2016.
  17. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder). 
  18. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
  19. Subject to any direction given under relevant State legislation, an unclaimed prize draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060 on Friday 15 July 2016 at 10:00 (AEST). The winner will be notified within 2 days of the draw. The winner will be notified of their prize in writing. Winners of prizes valued over $250 will have their details published in the Public Notices section of The Australian newspaper on Friday 22 July 2016.
  20. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
  21. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
  22. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
  23. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.
  24. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  25. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  26. Renault Australia, Falls Creek Ski Lifts Pty Ltd, Falls Creek Alpine Resort Management Board, Mount Hotham Skiing Company Pty Ltd, Salmat Digital Pty Limited and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  27. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.
  28. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent. 
  29. STANDARD OPT-IN: All entries become the property of The Promoter. All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.

Renault Trafic & Stanley Tools Competition Terms and conditions:

Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  1. Entry is only open to (1) Private ABN holders (including fleet owners) who are Australian residents aged 18 years or over, and, (2) Companies with an ABN (excludes Large Fleet, Government Fleet and Rental).   Entries made on behalf of an eligible company must be made by an adult authorised representative of the company who is an Australian resident aged 18 years or over (“Authorised Representative”) (collectively “Entrants”).
  2. Employees (and their immediate families) of agencies associated with this promotion, the Promoter, and authorised dealers of Renault Australia are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  3. Promotion commences 12pm AEST on 26/10/2015 and final entries close 11:59pm AEDST on 31/01/2016 (“Promotional Period”).
  4. To enter, Entrants must complete the following steps during the Promotional Period:
    • order (i.e. sign a contract for purchase and pay a deposit) or purchase (i.e. complete full payment) a new or on-sold demonstrator Renault Trafic (X82 or X83 model) from a participating Renault dealer during the Promotional Period (“Eligible Purchase”). For clarity, online entry can only be submitted after Eligible Purchase has been made. Both online entry and Eligible Purchase must occur within the Promotional Period.

  1. Orders that do not pay a deposit during the Promotional Period will be deemed to be incomplete and invalid under clause 10.
  2. If an Entrant cancels their Eligible Purchase order or returns their Eligible Purchase:
    1. before the winner has been chosen; or;
    2. after the winner has been chosen but before the prize has been delivered,

the cancelled transaction will cease to be an Eligible Purchase, the entry will be deemed to be invalid, the Entrant will forfeit any right to or interest in the prize and the prize will be given to the Entrant with the entry judged the next-best entry.

  1. Entrants must retain their original contract for purchase and receipt/invoice of payment (deposit or full payment) for their Eligible Purchase (“Required Documentation”). Failure to produce the Required Documentation when requested may, in the absolute discretion of the Promoter, result in invalidation of an Entrant’s entry and forfeiture of any right to any prize. Contract for purchase and receipt/invoice must clearly specify the participating Renault dealer and that the Eligible Purchase was made during the Promotional Period.
  2. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any Entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  3. The Promoter reserves the right, at any time to invalidate any entries which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information that has been submitted through the use of multiple identities, email addresses or accounts.
  4. Incomplete or indecipherable entries will be deemed invalid.
  5. Only one entry permitted per person.
  6. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged, based on the originality, literary merit and creative merit of the description provided in the entry [In 25 words or less, how would your business benefit from a trade-up to Renault and a tool-up with STANLEY®?].
  7. The judges may select additional reserve entries which they determine to be the next best, and record them in order of merit, in case of an invalid entry or an ineligible or disqualified Entrant.
  8. Judging will take place at the Promoter’s office on 25/02/2016 (“Judging Date”).
  9. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
  10. The winner will be notified by telephone and email within ten (10) business days of the Judging Date and the winner will be published online at http://www.renault.com.au/competition from 15/03/2016.
  11. The Promoter’s decision is final and no correspondence will be entered into.
  12. Prize: Subject to clause 6, the best valid entry, as determined by the judges, will receive a voucher to select Stanley tools (“Prize”) to the maximum value of $10,000 RRP. The winner can choose Stanley tools from the catalogue to be attached to the winner notification e-mail. The winner can only redeem the voucher by sending a return e-mail to the Promoter detailing the Stanley product codes disclosed in the Stanley catalogue. The voucher cannot be used before the expiration of 4 weeks from the date of notification (“Qualifying Period”) referred to in clause 16, nor after 12 weeks after the date of notification (“Deadline”).
  13. If the winning entry was submitted by an Authorised Representative, the Prize will be awarded to that Authorised Representative.
  14. Any ancillary costs associated with redeeming the Prize are the sole responsibility of the winner.
  15. Neither the Prize nor any unused portion of the Prize is transferable or exchangeable and cannot be taken as cash.
  16. Redemption of the Prize is subject to any terms and conditions of the issuer including those specified on the Stanley voucher.
  17. Any tax liability or duty arising from a winning Entrant’s participation in the Promotion is the responsibility of the winner. Independent financial advice should be sought by an Entrant if required.
  18.  If for any reason (including but not limited to disqualification in accordance with clauses 6 and 10 of these Terms and Conditions) a winning Entrant does not redeem the Prize before the Deadline, then the Prize will be given to the next best judged entry, and if there is no next best judged entry, the Prize will be forfeited.
  19. If the Prize or any part of the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal value and/or specification.
  20. Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to the description provided on entry (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever.
  21. Entrants warrant and agree that:
  1. they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 16, or otherwise unsuitable for publication;
  2. their Content shall not contain viruses or cause injury or harm to any person or entity;
  3. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
  4. the Content is the original literary work of the Entrant and does not infringe the rights of any third party;
  5. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
  6. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
  1. Without limiting any other terms herein, an Entrant agrees to indemnify the Promoter for any breach of the terms contained in clause 27.
  2. As a condition of entering this promotion, each Entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
  3. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  4. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  5. Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the Internet service provider used.
  6. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
  7.     11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
    12. This is a game of skill and chance plays no part in determining the winner. Additional spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The winner must finalise the prize booking within 90 days of the judging date and all travel must be completed within 12 months of the judging date. The winner must book the prize trip at least 60 days prior to intended travel departure. The prize is a single event holiday and cannot be separated into different holiday vacations.     26. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

    28. If the competition winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian has entered on their behalf.

    30. The judge’s decision is final and the promoter will not enter into correspondence regarding the Competition result.

    33. All reasonable attempts will be made to contact the Winners. If a prize remains unclaimed by a winner or unallocated or forfeited for any reason, by 9am on Monday 1 February 2016, the prizes will be re-allocated to the entrant that has submitted the entry which best meets the judging criteria excluding the entrant that has failed to claim the prize.     34. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
    35. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition

    1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
    2. Entry is only open to Australian residents aged 18 years or over.
    3. Employees (and their immediate families) of the Promoter, authorised dealers of Renault Australia and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves the right, at any time to invalidate any entries which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information that have been submitted through the use of multiple identities, email addresses or accounts.
    9. Incomplete or indecipherable entries will be deemed invalid.
    10. Only one entry permitted per person.
    11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

    17. If, in the event that (a) an entrant cancels their Eligible Purchase order or returns their Eligible Purchase before a prize draw occurs; or (b) a winner cancels their Eligible Purchase order or returns their Eligible Purchase after a draw has occurred, then that entrant/winner will forfeit any right to a prize and will be required to return the prize to the Promoter.

    14. Total prize value is up to = $15,565 (including GST).
    15. Prizes cannot be transferred or cannot be redeemed for cash.
    16. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable.
    17. Renault Australia, Salmat Digital Pty Limited and Carrspace make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.
    18. By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in this Ski Holiday should they be chosen as the winner. The winner release the promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the Ski Holiday or any other aspect of the prize. The winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize.
    19. The prize must be taken by 27 September, 2015 or by the end of the Fall Creek 2015 Winter Snow Season (whichever occurs first) and is subject to hotel availability.
    20. FOR CAR HIRE AND LOAN AGREEMENTS: The winner must comply with all Renault Australia’s Loan Vehicle Acceptance Form at the time of the loan. The vehicle cannot be driven out of 600km from the metropolitan area it is loaned from and must only be driven on sealed roads.
    21. In the event that the vehicle is involved in an accident or damaged in anyway, an Accident/Damage Report in the form required by Renault Australia must be completed and forwarded to the  Renault Australia dealer that the vehicle was collected from within 24 hours of the damage occurring. Repairs to the vehicle are not to be undertaken without the written consent of Renault Australia dealer or its appointed assessor.
    22. Renault Australia dealer retains the title to the vehicle and the winner must not purport to sell, pledge, mortgage, lend, transfer, or in anyway encumber the vehicle. All costs relating to insurance, registration, service, repairs, etc, of the vehicle will be borne by Renault Australia dealer except for the following items which the winner will be responsible for including but not limited to any negligent act performed by the driver or passengers involving the said vehicle: any loss or damage caused to, or by, the vehicle should the winner (or driver) be intoxicated or under the influence of medication or drugs whilst in control of the said vehicle: or any fines or penalties incurred for traffic infringements whilst the vehicle is in the custody and control of the winner (or nominated driver). The winner is to return the car to Renault Australia immediately upon completion of the Ski Holiday and if the winner fails to do this, Renault Australia is irrevocably authorised to enter any premises in which they believe the vehicle to be situated and take possession of and remove the vehicle.
    23. The winner will be responsible for, including but not limited to any negligent act performed by the driver or passengers involving the said vehicle: any loss or damage caused to, or by, the vehicle should the winner (or driver) be intoxicated or under the influence of medication or drugs whilst in control of the said vehicle: or any fines or penalties incurred for traffic infringements whilst the vehicle is in the custody and control of the winner (or nominated driver).  The driver of the car must have a current Australian State or Territory license (which is not under suspension or cancellation) as at the date on which the winner (or companion) is to drive the vehicle.
    24. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner.
    25. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
    26. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.  It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
    27. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
    28. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed throughout the duration of the prize.
    29. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
    30. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with Renault Australia or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
    31. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
    32. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
    33. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
    34. Each valid entrant who has entered the competition over the duration of the promotional period will be entered into the draw.  One (1) valid entrant will be drawn at random to become the winner. The draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North Sydney NSW 2060, on Monday 3 August, 2015 at 10:00 (AEST).
    35. If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.
    36. The winner will be notified within 2 days of the draw. The winners will be notified of their prize in writing. The winner will have their details published in the Public Notices section of The Australian newspaper on Wednesday 5 August, 2015.
    37. Prizes will be awarded to person named in the entry. In a dispute promoter will request valid identification to verify identity.
    38. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
    39. FOR EVENT BASED PRIZES: Travel must be taken by 27 September, 2015 or by the end of the Falls Creek 2015 Winter Season (whichever occurs first). If a winner and travelling companion are, for whatever reason, unable to travel on a nominated date, or do not take an element of the prize within the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. Cash will not be awarded in lieu of the prize or element thereof.
    40. The major prize must be claimed by Thursday 09:00 6 August, 2015 and if the major prize remains unallocated or unclaimed, a further draw will be conducted on Thursday 6 August, 2015 at 10:00 at the same place as the original draw (subject to any directions given under all State Regulations). In the event of a re-drawn winner, their details will be published in the Public Notices section of The Australian on Thursday 13 August, 2015.
    41. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result.
    42. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
    43. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
    44. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation.
    45. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
    46. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
    47. Renault Australia, Salmat Digital Pty Limited and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
    48. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.
    49. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent. 
    50. STANDARD OPT-IN: All entries become the property of The Promoter. All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
    51. You consent to Salmat Digital Pty Limited, on behalf of The Promoter,  to collect your personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the winner and prize fulfilment). Your personal information may be disclosed to third party service providers for this purpose. Your personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter. If you are not willing for this to occur you cannot participate in the promotion.

Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    6. If there is a dispute as to the identity of an applicant, the Promoter reserves the right, in its sole discretion, to determine the identity of the applicant.
